The voters of Fishers and Fall Creek Township will have the opportunity to vote on the merger in Nov 2012. If the voters decide to merge, the Fall Creek Township (FCT) and Fishers government will change.
1. The FCT trustee and board will be eliminated. The FCT trustee, Jeff Hern, would become a new Fishers town council member.
2. An unincorporated resident would be appointed to the new Town Council. This person would be appointed by the Fishers Town Council president, The Fall Creek Township Board president and the Hamilton County Commissioner president. Only two of the three presidents need agree to this appointment. The presidents are:
1). Fishers - Scott Faultless
2). FCT - Dan Rieke
3). County - Steve Holt
3). These two individuals would increase the number of town council members to 9 with each being paid $12,000 per year salary.
4) The Fishers town council will still all be elected at-large. This means all Fishers residents will vote for all members. Will Fishers really have true representation if they all are elected at-large?
5) The Fishers Town Clerk, which is an elected postion by the people, would be eliminated and would be appointed by the Fishers Town Council. The elected town clerk is a checks and balances to the town council. The town clerk is directly accountable to the people. If the merger wins, the town council appoints the clerk and the clerk would not have authority to be an oversight to its "bosses". The clerk oversees the finances of the town.
6). The Town of Fishers would be named The City of Fishers. It is a city in name only. It is known as either a Hybrid City or a Modern City depending on the way that a person views the new government.
7). The 9 "City" Councilors who would have appointed a town board president, would appoint a "mayor". The town council president would now be named the "Mayor".
8) The mayor would not have any authority like a tradition city mayor such as veto or checks and balances authority. The "mayor" would only have the same authoity as a town council president. The Mayor would not be the executive branch. It would still be the legislative branch. There would not be any checks and balances from the Mayor and City Council like a Traditional City.
Summary: This Hybrid City or Modern City is a worse form of government than the Town form of government since it eliminates the Town Clerk, a vital checks and balances to the town council.
The new Mayor is not a checks and balances to the new city council since it is still a council president in duties and roles. What this means is that Fishers residents do not have as much oversight into its government.
If the merger wins, it is unlikely that the citizens if Fishers will have the ability to change its form of government in the future because of the merger laws, so
choose wisely.
